For this, it would be useful if we = could have a certificate issued by an external accountant of the company ce= rtifying that the product description for "GX1400GW" in these invoices corr= esponds to "HORIZON". Note that the accountant must be external and not an = employee. For instance from an external auditing company. Please be advised that to successfully defend the registration, the owner should demonstrate a =93sufficient use= =94 of the mark. In this case, the invoices that do not include the tradema= rk =93HORIZON=94 or =93STANDARD HORIZON=94 would not provide elements to co= nclude that the mark has been used sufficiently.

 

Regarding= the evidence, our suggestions to strengthen it: 

 

  1. Submitting an agreement between VERTEX STANDARD USA INC. and YAESU to= prove that the use of the trademark in Colombia has been made by an author= ized party. Please bear in mind that the name of the owner of the trademark, =93VERTEX STANDARD USA INC.=94 does not sho= w in any of the documents you have sent to us.<= o:p>
  2. It would be helpful if you could obtain from your client (TODOMAR C.H= .L) an affidavit or certificate to show that they buy and sell products und= er the trademark =93HORIZON=94 (with the complete name, as opposed to =93<= span style=3D"color:black;background:white">GX1400GW=94), inc= luding an approximate date of when they started purchasing these goods the = amount bought.
  3. On the in= voices. Although the product =93STANDARD HORIZON=94 can be seen in the =93I= tem=94 section with the reference =93GX1400GW=94, we need to prove that this refers to the trademark =93HORIZON=94 itself, by explai= ning to the examiner that =93GX1400GW=94 stands for =93HORIZON=94. For this= , it would be useful if we could have a certificate issued by an external a= ccountant of the company certifying that the product description for =93GX1400GW=94 in these invoices corresponds to = =93HORIZON=94. Note that the accountant must be external and not an employe= e. For instance from an external auditing company. If we do not file this a= dditional affidavit, the examiner will say that =93GX1400GW=94 is not =93HORIZON=94, or that there is no evidence to = prove otherwise. Not all the invoices include said reference.=
  4. If possible, a certificate issued by accounting auditors certifying t= he regularity and the extent of the commercialization of the goods covered = with the trademark would be really helpful in this case.
  5. Regarding the document =93GX1400 Photos=94: this will not be accepted= by the examiner as these are just cropped pictures placed in a PDF file.&n= bsp; There is no evidence of the date or site where they come from. We suggest if possible, using the complete extract of the site = where this ads were placed and information where the relevant period is vis= ible.

We can draft the documents for the points 1, 2, = 3, and 5. The costs related to these are $ 900.oo + VAT (16%).  =

Please be  informed that the Colombian Trad= emark Office has recently issued an Official Letter No. 19419/2023 (attache= d), through which the cancellation action filed by TOGO INVESTMENTS GROUP S.A.S on November 10, 2023, against the HORIZON trademar= k(nominative) Registration N=B0354925 in Colombia, owned by VERTEX STANDARD= USA INC.

 

In view of the above, VERTEX STANDARD USA INC. h= as been required to present evidence of genuine use of its HORIZON (nominat= ive) trademark. We ask you to keep in mind that if you do not present sufficient evidence of use, the trademark registrati= on will be canceled.

 

The evidence must include the owner, place, time= , extent and nature of the use of the mark for the products it protects, in= support of:

 

i= .   &= nbsp;           &nbs= p;     Use of the trademark by VERTEX STANDARD = USA INC., a licensee or third party duly authorized to carry out such use (= in this case a copy of the contract concluded between the client and the distributor would be necessary)

i= i.   =             &nb= sp;   Effective marketing of products in Colom= bia or any of the Andean Community Countries (Peru, Bolivia or Ecuador)

i= ii.   = ;            &n= bsp; Use of the trademark must be demonstrate= d within the last three years of the relevant period, which runs from Novem= ber 10, 2020 to November 10, 2023.

i= v.   =             &nb= sp; Use of the trademark for products protec= ted in class 9.

v= .   &= nbsp;           &nbs= p;   Use of the trademark in accordance with = the normal marketing conditions of the market, in accordance with its natur= e.

 

Some examples of proofs that can will be filed, = as evidence of use, are the following:

 

=95 Proof of sales, advertising costs (if possib= le, supported by financial certificate).

=95 Purchase orders for the products offered, in= voices with clear reference to the use of the HORIZON brand, accounting doc= uments.

=95 Photos of the products offered that use the = trademark HORIZON; these must have the date and time on which they were tak= en or be accompanied by a declaration certifying the place and date on which they were taken.<= /o:p>

=95 Brochures, advertising in which  you se= e the trademark HORIZON.

=95 Articles about the products offered by HORIZ= ON, if it exists.

 

Please keep in mind that the Trademark Office gi= ves greater evidentiary value to invoices and sales certifications issued b= y tax auditors or accountants when deciding the use of a trademark in the market.

 

Finally, we found that TOGO INVESTMENTS GROUP S.= A.S made the application for the HORIZONE (mixed) trademark and said applic= ation was denied based on the trademark subject to cancellation HORIZON. This explains the reason for filing the trademark= cancellation request.

 

The official letter gives us a legal term of 60 = business days to present proof of use, which ends on February 16, 2024 (non= -extendable). After this term, the trademark will not be able to defend itself and will be cancelled.

 

In case client is interested in filing the defen= se of the trademark, we would appreciate receiving the documents on the pro= of of use before February 6, 2024, if possible, so that we have enough time to prepare the study of the evidence and prepa= re the presentation of the defense.<= /span>
